Terms of Service

In force since 12.10.2026

This is a courtesy translation. In case of any discrepancy, the Bulgarian version at https://fincontrol.bg/terms prevails - it is the legally binding text.

1. Parties

These terms govern the relationship between Fincontrol EOOD, UIC 208331221, registered seat and address of management: Sofia 1618, 27 Bratya Buxton Blvd., Bulgaria, contact email office (at) fincontrol.bg ("Fincontrol.bg", "the Platform", "we") and every natural or legal person who registers for and uses Fincontrol.bg ("User", "you").

By ticking the corresponding box on sign-up you declare that you have read, understood and accept these Terms and the Privacy Policy in full. If you do not agree with them, do not use the Platform.

2. What the service is

Fincontrol.bg is software for accounting, payroll and tax services for small and medium-sized enterprises in Bulgaria: keeping accounting entries, processing invoices and receipts (including through artificial intelligence), calculating salaries and social security, generating files and returns for the revenue agency, financial statements, documents and minutes of general meetings.

The service does not replace consultation with a registered auditor, tax adviser or lawyer. The calculations and generated documents are based on the legislation in force at the time and on customary accounting practice, but remain a proposal requiring review - the ultimate responsibility for the accuracy, completeness and timely filing of declarations, returns and documents with the revenue agency, the social security institute, the Commercial Register or any other authority remains entirely with the User (respectively with the accountant, if you have assigned the processing to an accounting practice through the Platform).

Territorial scope. The Platform is intended for companies registered in Bulgaria and is currently offered only to visitors from the country - access to the website from other countries may be refused. The restriction does not apply to the personal panel of registered users: they can work with their account while abroad. If you have grounds to use the Platform outside Bulgaria, write to office (at) fincontrol.bg and access may be granted to you.

3. Registration and account

4. Subscription and payment

Access to the Platform is granted only after choosing a plan and paying the subscription - payment is made before access is activated. When a subscription expires the account is restricted, but your right to download your own data (handover package) is not restricted - it is available with an expired subscription as well.

Prices and VAT. All prices on the Platform and the website are final. Fincontrol EOOD is not registered under the Value Added Tax Act and does not charge VAT - no tax is added to the stated price and the payment document is issued without VAT. If this changes, we will notify our clients in advance. Plan prices stated up to and including 31.12.2026 are promotional; from 01.01.2027 the regular prices stated on the Platform and the website apply.

Companies and plan limits. The number of companies, monthly AI readings, employees, users and file storage are stated on the page of each plan. On the plans for business owners the AI readings and the employees are a shared count for all companies in the plan, while file storage is counted for each company separately. A company above those included in the plan can be added for a monthly price, up to the maximum stated for the plan; an added company does not increase the shared count of readings and employees. Documents entered manually (without AI reading) are limited to the monthly number stated for the plan, and above it to a pack of manually entered documents; invoices issued from the platform do not count. On the plans for accountants all limits are shared across the client companies. Unused readings do not carry over to the next month. Subscriptions paid up to and including 13.10.2026 keep the terms in force at the time of payment: each added company brings the extra readings stated then and employees are counted for each company separately.

Reading packs. A one-off pack of AI readings can be bought on top of a plan, including the "Switching from other software" pack for the current year's documents. The pack does not expire: the plan's monthly limit is used first, then the pack. Offers (for example free readings with an annual plan) run for the period and on the terms announced in the Platform and are granted once per company.

Connected shop. For a monthly add-on to the plan, the Platform uses a read-only key to fetch the transactions of the online shop's payment provider (sales, fees, refunds, payouts) and books them. Registering the online shop with the National Revenue Agency, the accuracy of the data in the payment provider and - unless the "Documents to the buyer" upgrade is included - handing the sales document to the buyer remain the client's responsibility. Sales to buyers outside Bulgaria by a VAT-registered company are not booked automatically but flagged for review. The add-on can be cancelled at any time; the fetched data stays.

5. Right of withdrawal and refunds

The Platform is provided for the purposes of a commercial or professional activity - to traders, sole traders, self-insured persons and legal entities. For them the right of withdrawal under Art. 50 of the Consumer Protection Act does not apply, because that right is provided only for consumers within the meaning of the law (natural persons acting outside their commercial or professional activity).

If you nevertheless conclude the contract as a consumer (a natural person acting outside a commercial or professional activity), the service constitutes digital content not supplied on a tangible medium. On payment you expressly state that you wish performance to begin immediately and confirm that you know you thereby lose your right of withdrawal - Art. 57(13) of the Consumer Protection Act. The consent is given by a separate tick before payment and is recorded (date, time and the address it was given from).

Refunds. If you want to end the subscription before the end of the paid period, we refund the amount for the unused time, calculated on a daily basis, less the payment processing fee (see below). The subscription and the ability to work stop on the date of termination. In case of a technical problem caused by us that makes the Platform unusable and is not resolved within a reasonable time, we refund the amount paid for the unused period in full, without deducting the processing fee.

If a right of withdrawal is nevertheless exercised within the 14-day period (a consumer who has not given the consent under the preceding paragraph), the amount is refunded with the following deducted:

The reason is that the service is provided and genuinely accessible from the moment of payment - Art. 55 of the Consumer Protection Act provides precisely for payment of a proportionate amount for what has already been supplied.

Payment processing fees. When we refund an amount to a company or another person using the Platform for business or professional purposes - at our decision, by agreement or on any other ground - the fee withheld by the payment service provider for processing the original payment is not refunded by it and is deducted from the amount refunded. That is, you receive what you paid, less the processing fee. Its size depends on the payment method used and is stated on request. The fee is not deducted when a consumer exercises the right of withdrawal - the refund is then free of charge for them, as the Consumer Protection Act requires.

Termination. You can end the subscription at any time. You have two options: stop future charging from the “Subscription” screen and keep working until the end of the period already paid for, or ask for immediate termination with a refund of the unused time under the preceding paragraph. Regardless of the termination, the right to download your own data is not restricted - for the period in section 9.

Termination by us for abuse. We reserve the right to refuse or terminate access to the Platform in case of a material breach of these terms. The following count as such in particular: submitting false data on registration or in the declaration that you own, manage or are authorised to keep the books of the company you add; keeping the books of another company without a legal basis; repeated refund requests after genuine use of the service; circumventing plan limits, including automated account creation or sharing access beyond the number of users in the plan; acts that endanger the security or operation of the Platform, or attempts to reach another user's data; and use of the Platform for unlawful activity.

Where a breach can be remedied, we notify you and allow a reasonable period to do so before terminating. On termination under this clause, amounts paid for the remaining period are not refunded, insofar as the termination is caused by your own conduct. Your right to export your own data remains in this case as well, unless providing it is prohibited by law or would affect the rights of third parties.

5a. Publishing annual financial statements

What it is. The enterprise's annual financial statements are published online on a page in the "Published reports" section of fincontrol.bg. The service is intended for enterprises that publish their statements online (Art. 38(1)(3) of the Accountancy Act) - for example civil-law partnerships, consortia and commercial representative offices. For traders and non-profit legal entities, publishing here is only additional and does not replace filing with the Commercial Register or the register of non-profit legal entities.

Declaration of no activity. The declaration under Art. 38(9)(2) of the Accountancy Act is published in the same way and at the same price. The provisions of this section on the statements apply to it too.

Price and payment. For a company with an active subscription on the Platform, publishing is free. For everyone else the price is €5 per report - a final price, as Fincontrol EOOD is not VAT-registered. Payment is by card before publication; the payment document is sent to the email provided.

Access. The published report is freely accessible to anyone, free of charge and without registration, for 5 years from the date of publication. Each report gets a permanent link; the date and time of publication and a checksum of the file are recorded and shown on its page.

Content and responsibility. The report is published as uploaded, without alteration and without any review of its content by us. The enterprise publishing it is responsible for the accuracy and completeness of the report, for meeting the publication deadline and for the right to publish any personal data it contains. We may remove a publication that is clearly not a financial statement or a declaration under Art. 38 of the Accountancy Act, or that breaches the law.

Removal at the enterprise's request. A publication is removed upon the enterprise's written request. Where the report was published to meet the obligation under Art. 38 of the Accountancy Act, removal before 3 years have passed since publication may breach the free-access requirement (Art. 38(7)) - the enterprise bears responsibility for this.

Withdrawal and refunds. The service is provided for commercial or professional purposes and the right of withdrawal under section 5 does not apply to it. The service is performed once the report is published and the amount paid is not refunded afterwards, except in the case of a technical problem on our side that prevents publication. A report submitted without registration and not paid within 3 days is deleted.

Discontinuing the service. If we discontinue this service, we will notify the enterprises by email at least 3 months in advance so that they can publish their reports elsewhere.

6. Artificial intelligence (AI) in document processing

When you upload invoices, receipts or cash register reports for automatic reading, the content of the document (including any personal data shown in it) is sent for processing to Anthropic (provider of the Claude API) - a third party outside the EU. The feature is optional: you can enter documents manually, without AI reading. The AI proposals for an accounting entry or tax treatment are subject to review and confirmation by the User before posting - the Platform bears no responsibility for inaccuracies in automatically read data left unchecked and confirmed by the User.

6a. Confidentiality of your data

What is confidential. Everything you enter or upload in the Platform - accounting documents, invoices, bank statements, data on counterparties, employees and pay, and everything prepared from them - is confidential. We do not sell it, do not disclose it to third parties and do not use it for advertising.

When information is disclosed without your consent. Only where the law obliges us and only to the extent the law requires:

Outside the anti-money-laundering case, where the law allows, we inform you of a request we receive.

Who else has access. The people you have given access to yourself (invited colleagues and clients) and the providers without whom the service does not work - hosting, backups, AI document reading and card payments. They are described in the Privacy Policy and receive data only to perform their part of the service.

Published reports. Documents you publish yourself under section 5a are public by law. Confidentiality covers the data they are prepared from, not the published report.

Our staff and after the contract ends. Everyone who works with your data on our side is bound to keep it secret. Our confidentiality obligation continues after the contract ends.

7. Changes to the Platform

We reserve the right at any time to change, extend, restrict or discontinue individual features of the Platform, including in connection with changes in legislation, in the statutory formats of the revenue agency and the social security institute, or technological improvements, without this constituting a breach of contract. For material changes affecting the scope of your subscription we will make reasonable efforts to notify you in advance.

8. Liability and limitation of liability

The Platform is provided “as is” and “as available”. We take care that the calculations, declarations and documents generated by the Platform comply with the Bulgarian legislation in force at the date of generation, but we do not guarantee absolute freedom from error in every possible case, nor uninterrupted or trouble-free operation of the service at all times.

To the maximum extent permitted by applicable law, Fincontrol.bg, its owners, employees and accountants bear no liability for:

Nothing in these terms limits liability which cannot be limited or excluded under mandatory rules of Bulgarian or European law - including our obligations as a controller or processor of personal data under Regulation (EU) 2016/679 (GDPR), described in detail in the Privacy Policy.

Notwithstanding the limitations above, we take the reliability of the service seriously: personal data is stored encrypted, we take daily backups of the entire database, and access to the system is protected by automatic rate-limiting of failed login attempts and a check against automated attacks (reCAPTCHA).

9. Termination

You can stop using the service at any time. After the subscription ends, your data and documents stay in the Platform and you can download them free of charge for 12 months - a full archive and a handover package for other software or an accountant.

After that period, if you have no active subscription or paid storage, we may delete the company's data and documents. We notify you by email at least 30 days beforehand. If you want them to stay with us, you can order paid storage: €2 a month for every 10 GB or part of it, with view and download access only. Order it at the email in section 11.

The obligation to keep accounting information for the periods in Art. 12 of the Accountancy Act lies with the enterprise itself. The Platform is a tool for keeping the books, not a statutory archive - so we recommend downloading your data before the period in the preceding paragraph ends.

10. Governing law and disputes

These terms are governed by Bulgarian law. Any dispute in connection with them is settled by mutual agreement and, failing that, by the competent Bulgarian court at the seat of Fincontrol.bg, respectively by the Commission for Consumer Protection (kzp.bg) for disputes with consumers within the meaning of the Consumer Protection Act.
